{"id":2079,"date":"2024-07-19T17:27:40","date_gmt":"2024-07-19T17:27:40","guid":{"rendered":"https:\/\/familiasmadridnorte.es\/?p=2875"},"modified":"2024-07-19T17:27:40","modified_gmt":"2024-07-19T17:27:40","slug":"reclamaciones-gastos-hipotecarios","status":"publish","type":"post","link":"https:\/\/familiasmadridnorte.es\/en\/reclamaciones-gastos-hipotecarios\/","title":{"rendered":"RECLAMACIONES GASTOS HIPOTECARIOS"},"content":{"rendered":"<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"http:\/\/familiasmadridnorte.es\/wp-content\/uploads\/2024\/07\/gastos-hipotecarios-1024x577.jpg\" alt=\"\" class=\"wp-image-2876\"\/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Nueva sentencia sobre reclamaciones de los gastos hipotecarios <\/h3>\n\n\n\n<p>El despacho jur\u00eddico AFEPLUS ABOGADOS, entidad colaboradora de FEDMA, nos informa que el pasado d\u00eda 14 de junio de 2024, el Tribunal Supremo (TS), de acuerdo con la doctrina establecida por el Tribunal de Justicia de la Uni\u00f3n Europea (TJUE), ha establecido que:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Salvo en aquellos casos en que la entidad prestamista pruebe que, en el marco de sus relaciones contractuales, ese concreto consumidor pudo conocer en una fecha anterior que esa estipulaci\u00f3n era abusiva, el d\u00eda inicial del plazo de prescripci\u00f3n de la acci\u00f3n de restituci\u00f3n de gastos hipotecarios indebidamente pagados por un consumidor ser\u00e1 el de la fecha de la firmeza de la sentencia que declara la nulidad de la cl\u00e1usula que obligaba a tales pagos.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 quiere decir la sentencia?<\/h3>\n\n\n\n<p>Que los gastos hipotecarios (Notar\u00eda, Registro Propiedad, Gestor\u00eda y Tasaci\u00f3n) se pueden reclamar incluso de hipotecas canceladas y firmadas hace m\u00e1s de 20 o 30 a\u00f1os, ya que al ser la cl\u00e1usula que obligaba al consumidor pagar todos los gastos nula de pleno derecho, no existe plazo de prescripci\u00f3n, siempre y cuando no haya una sentencia que declare la nulidad de la cl\u00e1usula que obligaba a tales pagos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfC\u00f3mo puedo saber si puedo reclamar los gastos hipotecarios?<\/h3>\n\n\n\n<p>El despacho, presta asesoramiento sin coste ni compromiso alguno para valorar la viabilidad de cada reclamaci\u00f3n, as\u00ed como de otras cl\u00e1usulas abusivas, para ello necesitan copia de la escritura de la hipoteca en formato pdf.<\/p>\n\n\n\n<p>Las entidades bancarias est\u00e1n obligadas a pagar el principal abonado (gastos hipotecarios) m\u00e1s los intereses legales de demora en funci\u00f3n de la fecha del abono de los gastos.<\/p>\n\n\n\n<p>EMAIL para solicitar la informaci\u00f3n : bancosafeplus@gmail.com<\/p>\n\n\n\n<p>AFEPLUS.
